What is a Chapter 13 bankruptcy?
Chapter 13 of the bankruptcy code is designed for individuals with regular income who would like to pay all or part of their debts in installments over a period of time. Usually, the repayment plan lasts for 36 months to 60 months in length. You are only eligible to file a Chapter 13 bankruptcy if your debts do not exceed certain dollar amounts set forth in the bankruptcy code.
If your total household income, as calculated under the bankruptcy code, exceeds a certain annualized sum, then you may not be eligible to file Chapter 7 bankruptcy and you may be required to file for Chapter 13 bankruptcy in order to resolve your debt issues.
Under Chapter 13 laws, you must file with the court a Plan to repay your creditors all or part of the money that you owe them, using your future earnings. The period of time allowed by the court to repay your debts may be from three years to five years, depending on your income and other factors.
After completing your payments under your confirmed Chapter 13 plan, your debts are generally discharged with certain exceptions including domestic support obligations, most student loans, certain taxes, most criminal fines, and certain long-term security obligations such as mortgages and car loans.
